Since the full implementation of the National Credit Act, specifically Act 34 of 2005, on June 1st of 2007, the debt management landscape has undergone a transformative change. The introduction of debt review and restructuring has aimed to address the financial challenges major credit providers impose on consumers. Debt Counselling Companies, in collaboration with the National Credit Regulator, play a crucial role in helping consumers become debt-free by providing tailored solutions based on their affordability.
The Helping Hand was established in 2013 to cater to the growing need for debt relief. Our primary mission is to assist over-indebted consumers and provide them with a pathway to financial freedom. Starting with a single branch in Giyani, we have expanded our reach to include locations in Polokwane and Pretoria. This expansion is a testament to the increasing demand for our essential services.

Mahlori Ngobeni
The Helping Hand Debt Counsellors is an organization founded and currently led by Mr. Mahlori Ngobeni. He is a qualified and registered Debt Counsellor with extensive experience. Mr. Ngobeni grew up in Giyani, Limpopo where he completed his foundational education before pursuing a degree in Business at the Branson School of Entrepreneurship.
During his early years in high school, Mr. Ngobeni developed a passion for sales and marketing. This led him to establish his first company, THN IT Solutions, at a young age. THN IT Solutions deals in Information Technology Systems and Peripherals. Through his ventures, he travelled extensively throughout South Africa, where he realized the profoundly detrimental impact of debt on individuals. This led him to study more about the issue and eventually become a certified Debt Counsellor. He wanted to provide effective solutions to those struggling with debt. This journey culminated in establishing THN Debt Counsellors, which is now known as The Helping Hand Debt Counsellors.

Creditor Notification
Debt Counsellor Notifies credit providers and credit bureau of the Consumers application for Debt Review making use of the form 17.1.

No More Debt
Consumer may not incur any further debt (credit agreement or use overdraft / credit card) unless it is to consolidate debt.

What is Owed
Credit providers issue a certificate of balance(C.O.B) to the debt counsellor. This gives a picture of the consumer's debt situation where each credit provider is concerned.

Assessment
After a thorough assessment of the consumer's financials and C.O.B, the Debt Counsellor confirms to credit providers of the consumer's over-indebtedness or otherwise.

Negotiation
In the event that the consumer is indeed over-indebted and so their application is accepted, the debt counsellor and credit providers enter into repayment negotiations going forward.

New Committment
After the Negotiations, the Consumer makes a commitment to a payment plan and make a monthly payment to Payment Distribution Agent(PDA) for a set period of time.

Payment Distribution
Payment Distribution Agent distributes funds in terms of the payment plan (or debt rearrangement order in the event that it is granted) to all the consumer's credit providers.

Honouring Commitment
Consumer ensures that credit providers receive monthly payments as agreed in terms of an accepted proposal (or granted debt rearrangement order) to avoid termination.

Legal Matter
Matter is set down in court by the consumer's debt counsellor, it is at this point credit providers may oppose the matter in court if negotiation agreement was not reached.

The process is finalised in court by the granting of a debt rearrangement order by a judicial officer, the order is is honoured by the consumer and the credit providers.

Consumer’s financial position is reviewed annually by the Debt Counsellor, a clearance certificate is issued by the Debt Counsellor at the moment debt is settled.
